The National Prosecuting Authority Act (Act No. 32 of 1998) of the Republic of South Africa was adopted on 3 July 1998.
Date of commencement: Sections 9, 10, 12 and 17 on 1 August 1998. The remaining sections, excluding section 38, on 16 October 1998. Section 38 on 23 April 1999.
The Act makes provision for the establishing of a single National Prosecuting Authority (National Prosecution Authority) in accordance with the provisions of section 179 of the Constitution of the Republic of South Africa, 1996. Provision is made, among others, for the appointment of a National Director of Public Prosecutions and Directors of Public Prosecutions, and for their conditions of employment and those of public prosecutors.
The National Prosecuting Authority Act, 1998, amended by the National Prosecuting Authority Amendment Act, 2000 (Act No. 61 of 2000), replaced the Investigation of Serious Economic Offences Act, 1991 (Act No. 117 of 1991).
