Guernsey has an effective legislation in place that enables it to tackle financial crime and to restrain, confiscate, seize and recover the proceeds of crime. The criminal law of the Bailiwick of Guernsey is similar but not identical to English Law. Many Guernsey laws closely follow those in force in England because it is customary for Guernsey to look to English Law when enacting new criminal laws.

Since the commencement of the Criminal Justice (Proceeds of Crime) (Bailiwick of Guernsey) Law (1999) there have been some further major legislative developments in Guernsey, namely -

  • The Drug Trafficking (Bailiwick of Guernsey) Law (2000) - which consolidated and enhanced previous legislation. This legislation enabled the 1988 United Nations Convention against the Illicit Traffic of Narcotic Drugs and Psychotropic Substances ('the Vienna Convention') to be extended to the Bailiwick;
  • The Company Securities (Insider Dealing) (Bailiwick of Guernsey) (Amendment) Law (2001), which provides additional gateways for assisting foreign authorities; and
