AG on the spot over graft cases

Kenya Anti-Corruption Commission is frustrated by the Attorney-General’s inability to successfully prosecute graft cases, its report indicates.

The annual report for the financial year 2007-2008 shows that the commission had forwarded 111 reports on concluded investigations to the Attorney General. Of this, the AG has taken 70 cases to court but not even one has been concluded.

According the anti-graft agency, 27 files are still waiting for Attorney General, Amos Wako’s direction.

Meanwhile the report shows that KACC last year recovered nearly Sh3.7 billion out of which Sh2.9 billion was the recovery of Laico (formerly Grand) Regency Hotel.

This means the Commission recovered Sh800 million besides the Laico Regency property.

The Commission received 4,485 complaints between July 2007 and June 2008 at its headquarters and a further 359 at its Mombasa office.

This was however a drop from the number received in 2006/7 which stood at 8,188 and even those received in 2005/6 which stood at 7,888.

The commission attributed the decline to the General Election campaigns of 2007 and the post-election violence of early last year.

In regard to investigations on the Anglo Leasing security contracts, the commission’s report says international aspects were still pending, and this had delayed completion of the investigations.

“In the year under review, the commission continued to pursue international assistance though mutual legal assistance and agency to agency cooperation in its endeavour to cover the international aspects but with varied successes and challenges,” states the report.
