Although international cooperation in asset recovery is still a rela-tively new area in international law, it is an indictment of the effec-tiveness of mutual legal assistance (MLA) that it is often easier for States to recover the proceeds of corruption through ordinary civil action than through co-operation with other States. It is to be hoped that the new United Nations Convention against Corruption (2003) (UNCAC), together with the various initiatives by the G8 and others, will change this situation.
