Asset repatriation is the last step. Once the financial investigation is finished, after utilizing all the instruments available through UNCAC and the country's domestic legislation, as well as obtaining all the support required from foreign jurisdictions, the process of bringing the assets back into the country can begin.
The ICAR is conscious that the process for repatriation will vary from country to country. This is why the trainings are developed in a country specific fashion, bringing experts from the more frequently involved foreign jurisdictions.
There are two main ways in which assets can be forfeited in order to be repatriated: in personae and in rem. The choice will depend on which ones the requested country has in place, the evidence gathered, the time between the occurrence of the offence and the personal circumstances of the subject (e.g., if he/she is deceased or is not present in the jurisdiction where the assets where found). The training intends to explain each of these points in order to illustrate which is the most effective way in a case by case fashion.
