Law on combating corruption (LCC), 1998

The Law on combating corruption (LCC) of the Republic of Kasakhstan was adopted on 2 July 1998 and is aimed at protection of citizens' rights and freedoms, guaranteeing of National Security of the Republic of Kazakhstan from corruption threats, guaranteeing the effectiveness of state institutions, officials and others, who fulfils state functions.

The Law defines the main principles on fight against corruption, kinds of corruption crimes and conditions under which the responsibility arises.

LCC art 2 defines the notion of corruption which is similar to that of passive and active bribery: acceptance, personally or through intermediaries, of unlawful material goods and benefits by individuals exercising public functions as well as persons equivalent to them, if they accepted those benefits using their public powers and related opportunities or using their public powers otherwise in order to obtain any material benefit; individuals or legal entities equally commit corruption  if they give bribes to individuals mentioned above by providing them with said unlawful benefits (Par. 1).

Besides definitions related to the status of public officials, the Law on combating corruption sets a list of offences creating favorable conditions for corruption (LCC Art. 12) as well as corruption offences (LCC Art. 13)and establishes concrete sanctions for such activities if they do not lead to criminal liability but contain an act of illicit enrichment. Confiscation of property derived from such activities is a mandatory measure in all cases of illicit enrichment described above (LCC Art.18). It can be enforced in the event that the individual concerned refuses to surrender such property to the state authorities (Par. 3).

The law also regulates the civil consequences of corruption offences: LLC Art. 19 stipulates that all civil acts or legal acts of public officials or bodies that resulted from such offences can be declared ineffective by court of justice of by a authorized body upon a claim of an interested person or a state attorney.
