The 1978 Order extended to the Cayman Islands the provisions of the Evidence (Proceedings in Other Jurisdictions) Act 1975, a United Kingdom statute with modifications.
The EPOJ Order enables the Grand Court to provide assistance to a court or tribunal in another jurisdiction to obtain evidence for criminal and civil proceedings. Once proceedings are instigated the Court can in relation to criminal proceedings, make an order for the examination of witnesses, either orally or in writing, or for the production of documents.
Under the EPOJ Order, assistance maybe sought in relation to civil matters where proceedings have been instituted before the requesting court or institution before that court is being contemplated.
With regard to criminal matters assistance may only be rendered where proceedings have been instituted by the requesting court.
